PMT Achieves Dismissal in Commercial Dispute After Opposing Default Judgment Motion

Pillinger Miller Tarallo, LLP obtained a strong result for its client in New York County Supreme Court, successfully defeating a plaintiff’s motion for default judgment and securing dismissal of the claims in a contested Labor Law action.

In Joseph Nullet v. Joseph Nullet (Supreme Court, New York County, Index No. 157119/2022 – PMT: Commercial Litigation, Complex Multi-Party Litigation), the plaintiff sought a default judgment alleging that the defendant failed to appear or respond. PMT not only opposed the motion but cross-moved to dismiss the complaint, arguing that the procedural prerequisites for default were not met and that plaintiff had instead abandoned his claims.

The Court agreed, denying the plaintiff’s motion for default judgment and granting PMT’s motion to dismiss. The decision reinforces PMT’s ability to navigate intricate procedural disputes and to protect clients from unwarranted claims through strategic, timely motion practice.

This outcome underscores PMT’s continued success in resolving complex litigation disputes efficiently and effectively for its clients.
