In this case, liability and damages were both at issue. Our client was Pier 115 Bar & Grill, a tenant in a multi-tenant commercial building. Plaintiff was also the tenant of a multi-tenant commercial building. The injury occurred in a common area when she was hit in the head with a fire door.

Plaintiff made two arguments: First, our clients’ employees intentionally broke the door which led her to being hit and, in the alternative, that our client was responsible for making sure the area was hazard free.

We argued no control and no responsibility since it was a common area of the building. Plaintiff had no evidence that our clients’ employees did anything to the door. We also argued that Plaintiff did not have any damages. She claimed vision loss in her left eye from the injury, but had a record of vision problems in her left eye before the incident. Plaintiff also had no evidence of a head injury.

The case ended with a Defense Verdict.
