Pro se Plaintiff was traveling on U.S. Route 322 in Folsom, New Jersey, at the same time as our client, A.P. Construction, was patching repairs to pot holes in the highway on an overpass on New Jersey Route 54. As Plaintiff was driving below the overpass, a piece of debris struck her vehicle’s wind shield. Plaintiff claims she slammed on the breaks in shock and hit her head and face on the steering wheel and side window.

The work being performed was supervised by a representative of NJDOT who found no safety violations. Plaintiff made a $2.5 million demand.

On day three of trial, the jury returned a verdict determining that our client was not negligent with a unanimous “no”. The court ordered a judgment in favor of our client, A.P. Construction.
