This case involved a two-vehicle accident on Woodhaven Boulevard in Queens, New York. Both drivers alleged that they had a green light and the other vehicle had a red light. Our client made a left turn, while the other vehicle was proceeding straight when the impact occurred. There were no witnesses. Plaintiff alleged upper and lower back injuries, disc herniations and left shoulder and arm injuries. There was no surgery, but plaintiff had injections, manipulation under anesthesia and was out of work for 4 ½ months.
Photographs presented to the jury showed front-end vehicle damage on co-defendant’s vehicle and passenger side damage on our client’s vehicle. Our client was very familiar with the intersection, having lived a quarter mile away for the past 30 years. Co-defendant was not at all familiar with the intersection.
Co-defendant testified and admitted to observing our client’s vehicle in the intersection prior to impact and further she did not honk, swerve, or even press her brakes to avoid the accident
